Terms of Service & Privacy Policy

1. Eligibility and your responsibility

You confirm you are at least 18 years old and legally permitted to use the Game where you live and from wherever you access it. YOU ALONE are responsible for complying with every law and regulation that applies to you - including, without limitation, rules on cryptocurrencies and tokens, gambling, financial services, and taxation - even if such rules change frequently. You are solely responsible for your own tax treatment and reporting. If participation is not legal for you, you must not sign up or use the Game. The Owner is not your compliance officer and is not responsible for your legal or tax position.

Where the Game may not be used. The Game, including its virtual and in-game currency, tokens, simulated trading and markets, bots, wagers and duels, referral and clan rewards, donations, and processing of personal data, is a global product offered only to persons for whom all of it is fully lawful. It is NOT offered to, not directed at, and not intended for, and you must not use it if, you are resident in or a citizen of, or you access it from, the European Union or European Economic Area (EEA), the United Kingdom, the United States of America, or ANY other country, state or territory in which the Game or any of its features or subject matter would be unlawful or restricted, or would require any licence, registration or authorisation, or would trigger any local consumer-protection, data-protection, financial-services, securities, money-transmission, crypto-asset, gambling or betting, or tax regulation. This applies in particular, without limitation, to anything touching: cryptocurrencies and tokens; virtual or in-game currency; simulated or real trading and investment; financial, investment or advisory services; gambling, betting, wagering or prize competitions; referral or multi-level rewards; and the processing of personal data. You alone are responsible for determining whether the Game and each of its features is lawful for you where you live and from wherever you access it, and by ticking the box and creating an account you represent and warrant that it is, that you are not a prohibited person, and that you are not accessing from a prohibited place. If any part of the Game or its subject matter is or becomes unlawful, restricted or regulated for you, you are prohibited from using the Game and must stop and delete your account. If you use the Game despite this prohibition, you do so unlawfully, on your own initiative, entirely at your own risk, and in material breach of these Terms; in that case you alone are responsible for that breach and for the application of any law of a prohibited territory that results from your own unauthorised use, the Owner does not target that territory, does not consent to that use, and bears no responsibility or liability for it, and the Owner may block, suspend or delete your account without notice or refund and may bring or pursue any available claim or remedy against you for your breach, including recovering the losses, costs and time it incurs as a result.

2. Provided "as is", no warranty

To the maximum extent permitted by applicable law, the Game and all its software, features, servers and content are provided strictly "AS IS" and "AS AVAILABLE", with no warranty of any kind, express or implied, including no warranty that it will work, be available, be error-free, be secure, or be fit for any purpose. You use the Game entirely at your own risk. Nothing in these Terms excludes rights or guarantees that cannot be excluded under applicable law.

3. Donations and in-game tokens

Any USDT, USDC, satoshi or other value you send is a voluntary DONATION made of your own free will, with no counterparty, no guarantee and no expectation of anything in return. There is no support for unresolved tickets, no promise of any benefit, feature, payout or return, and no refunds. This is high risk. Never send or donate any amount you cannot afford to lose completely. The Owner does not custody your crypto and may refuse, return, freeze or screen any inflow to prevent abuse or comply with sanctions/AML obligations.

4. Entertainment only, not advice

The Game is for entertainment purposes only. Nothing in it is, or may be treated as, educational, financial, investment, trading, legal or tax advice. In-game "trading", "bots", "markets" and results are simulations and do not reflect real markets or guarantee any outcome.

5. Intellectual property

All content of the Game - including its code, software, artwork, characters, names, text, mechanics, designs and the FJUNIVERSE brand - is the exclusive intellectual property of František Juriš, the creator of FJUNIVERSE, and is protected by copyright and other laws. You receive only a limited, personal, non-exclusive, non-transferable, revocable licence to play the Game as provided. You must not copy, reproduce, share, republish, distribute, sell, scrape, data-mine, decompile, reverse-engineer, clone, or create derivative works from any part of the Game, in whole or in part, without the Owner's prior written permission. We will enforce our rights and pursue all available remedies, including injunctions, damages and costs. To the maximum extent permitted by applicable law, for any wilful or commercial infringement you agree to pay the Owner liquidated compensation of not less than USD 100,000 by SEPA transfer, plus all associated costs.

6. Assumption of risk; claims; liquidated compensation

You accept that all risk and all eligibility requirements rest with you before you register, as set out above. To the maximum extent permitted by applicable law, you agree not to bring, join or fund any lawsuit, claim or demand against the Owner arising out of or relating to the Game, your use of it, any donation, or any loss. Nothing in these Terms limits any right you have that cannot be waived under applicable law, including any non-excludable statutory right or your right to lodge a complaint with a competent supervisory or consumer authority. To the maximum extent permitted by applicable law, if you bring or fund a claim in breach of this section or of Section 8, you agree to pay the Owner liquidated compensation of not less than USD 1,000,000 by SEPA transfer, plus all costs, fees, and the value of time and money reasonably lost by the Owner before, during and after such action.

7. Limitation of liability and indemnity

To the maximum extent permitted by applicable law, the Owner, its affiliates and advertisers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, tokens, data or profits, arising from or related to the Game or your inability to use it. To the extent liability cannot be excluded, the Owner's total aggregate liability to you is limited to the greater of the amounts (if any) you paid the Owner in the 12 months before the event or EUR 100. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. You agree to indemnify and hold the Owner harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your unlawful use of the Game, your breach of these Terms, or your infringement of any third-party right.

8. Dispute resolution

Before starting any formal proceeding you agree to first contact us and try in good faith to resolve the matter informally. Any dispute that cannot be resolved informally shall be resolved exclusively by final and binding individual arbitration under the UNCITRAL Arbitration Rules then in force, administered by a neutral appointing authority, with the seat, language and procedure determined by the arbitral tribunal. These Terms and any such dispute are governed by the arbitration rules so chosen together with generally accepted principles of international commercial law, and are not subject to the law, the courts, or the regulatory authorities of any particular country. To the maximum extent permitted by applicable law, you agree that disputes will be resolved on an individual basis only and you waive any right to bring or participate in a class, collective or representative action, and you waive any objection based on your own place of residence or on any local law you were not permitted to rely on because your use was prohibited under Section 1. Each party bears its own costs, and the prevailing party may recover its reasonable legal costs to the extent the tribunal permits.

9. Rules of play

You agree not to: automate or manipulate any part of the Game with bots, scripts, browser developer tools or extensions beyond the features provided; access or attempt to access any account that is not yours; scam, phish, exploit or manipulate other users; alter, reverse-engineer or tamper with the Game's code, interface or mechanics; or use the Game for anything unlawful. Breaking these rules may result in restriction or a permanent ban of your account(s) - past, present and future - at the Owner's sole discretion.

10. Accounts and deletion

You are responsible for your account and credentials. You may delete your account in-game at any time; deletion anonymises your account and is irreversible, with no refund of anything spent or donated.

11. General

Severability. If any provision of these Terms is held invalid or unenforceable, it is severed and the remaining provisions continue in full force, and the invalid provision is replaced, so far as possible, by a valid one that most closely reflects the original intent. Changes. We may update these Terms for legal, security or operational reasons and will give reasonable notice of material changes; if you do not agree you may stop using and delete your account before a change takes effect. Force majeure. We are not liable for failures caused by events beyond our reasonable control (including server, network, third-party or blockchain outages). Assignment. We may assign these Terms (for example to a group company); you may not. Entire agreement. These Terms are the entire agreement between you and the Owner regarding the Game.

Privacy Policy

Controller. František Juriš, operating as FJUNIVERSE, an independent creator living in the Republic of Paraguay. The Game is operated from outside the EU / EEA and is not directed at the EU / EEA (see Section 1). Data-protection contact: privacy@student.frantisekjuris.eu. You may also reach us through the in-game support option or our community Discord. What we collect and why. Your chosen username and email (to create and activate your account and send important notices - legal basis: performance of our agreement with you); gameplay data such as level, satoshi, houses, quests, clan and referral source (to run the Game - performance of our agreement); and limited non-identifying technical data such as browser, device and network (to run and secure the service - our legitimate interest). For referrals we record only the referring domain of the link you clicked, never the full query string. Cookies. We use a strictly-necessary cookie to keep you logged in, and a functional cookie to remember an invite you clicked; any non-essential cookies are used only with your consent (see the cookie banner). Retention. We keep account data while your account exists; on deletion your data is anonymised. International transfers. Where data is processed outside the EEA (for example by hosting or communication providers), we rely on an adequacy decision or Standard Contractual Clauses. Your rights. Subject to law you may request access, rectification, erasure, restriction, portability, and object to certain processing, withdraw consent at any time, and lodge a complaint with your supervisory authority. Children. The Game and, in particular, donations, the token features and the referral/clan rewards are intended for adults (18+); we do not knowingly collect data from children below the applicable digital-consent age. No sale of data. We do not sell your personal information.
